    Has the estate been probated? Who is/was the executor?

    First, any question on law needs to include your general locale as laws vary by area.

    Unless the property was listed with you and your mom as joint tenants with right of survivorship, the property is part of her estate. This means the executor of the estate needs to have a new deed made deeding the property from the estate to you.

    This means an executor needs to be acknowledged by the Probate court. Some areas have "mini" probate where there is a simple estate so you don't have to go through the costs of a full probate.
