    F1 to H1B visa taxes - Tax Forms?
    Hi,
    I was in F1 OPT visa from January 2013 to September 2013 and in H1B visa from October till December 2013. I would like to know what forms should I fill for federal tax returns? I am an Indian citizen.

    The critical issue is your marital status.

    If you are married, you can wait until 1 June 2014 to file jointly with your wife under the MARRIED option of First Year Choice. You BOTH choose to be treated as resident aliens in such a case.

    If you are single, you will file Forms 1040NR-EZ and 8843 ONE LAST TIME, because you have not yet met the Substantial Presence Test (SPT) (the days while under the F-1 visa do NOT count for SPT).
