    Can I change the adoption petition?
    I live in the state of Illinois and I'm trying to adopt my 3 years old god son. I'm married but I put single when I file the petition. Would they find out I 'm married?

    Me and my husband haven't been together for a year yet.

    Yes you can ask to amend the petition. In most states they will require that you be married to adopt. The court will most likely require that a home visit to determine the suitability of the home be made.

    Where are the child's parents?

    You and your husband need to adopt, since this effects him also. Yes, your marriage is public record and easy to find. You do need to go in and modify it

    It appears that the original petiton was for an adoption by the OP, not a step-parent adoption. Adoptions by single persons are allowed in many places, however the OP's husband wouldn't become the adoptive father. If he wants to do so, the petition should have course be amended, but I note that it probably doesn't have to be amended, if they don't want to do so.

    My biggest concern was can or should I get it amended later on the line. My husband don't live with me at the time . Is it possible that I can get it amended once he move back to the state. We are still legally married. Since I put single and the Petition is filed I didn't know if or should I change it.

    Ask the state if they want you to make the changes. Explain in full the different circumstances and let them decide.

    What can happen??
    I'm 27 years old, work full time at a daycare in Elgin Illinois. I had my godson N for a year this month. I have two boys 10 and 5. I got legal guardian of N in March of this years . His Mother abandoned him and left him with me (dcfs ) was never involved. The mother is on drugs so bad the court told her she have to be clean and have a stable apartment with her name on the lease and she can file any petition until the child become 8 .so five years from now.The mother fails to maintain a reasonable degree, concerns, or responsibility as to the welfare of this child. My co- workers told me I should file to adoption N. I got an attorney and she said she the mom can lose her parental rights for abandoned N. N just turned 3 on the 6 of October the mother didn't call or show up her N Birthday party. N mom have been on drugs all her life and she lost all 3 of her kids been adopted by other people Dcfs have never involved. My friend knows the ( who suppose to be dad)father but his name is not on the birth nor they wasn't married when N was conceived. He contacted me yesterday stating he been looking for his child and that N mom lost contract last time he saw was 14 months ago. I told him that he have to the courts to get visitation. He claim he just got clean in the begging of this year and he got a job but lives with his girlfriend and he have a drug felony. My question is what are they chances of the court taking N from me placing him with his father? I told him I file for adoption he said he want his baby?? Can the putative father uses his rights by not seeing of supporting his child in 14 months?? Please help

    First, you gave too much personal info for the WEB, I edited out the non essential info.

    I'm curious how you got legal custody without DCFS or the father getting involved. But there is no predicting what a court will do. You have bonded with the N, but his father is blood.

    Thanks I'm new to the website . I got legal guardian because the mother sign for it and we went to court and the judge granted it.

    That's surprising, but as long as a court granted it.

    I strongly advise to stop assuming and presuming and get facts from the court you filed the petition with. Thoughts are not facts until they are checked and verified.

    Yes, if he does fight the adoption, then you can require a DNA test to prove paternity.

    If you are the primary custodial parent yes.

    Please stop creating new threads over the same issue. Anything related to your guardianship of your god son should be posted to this thread.

    That is possible. The court could possibly terminate his parental rights, in addition to those of the mother, and approve the adoption.

    Why not ask your attorney these questions?

    I will be asking my Lawyer Tuesday she been out of the office and wouldn't return until Tuesday. I didn't know it was such a big problem. How do I delete this thread?
