    Tax return , H1B
    Hi ,

    I am on H1B status and my wife is back in INDIA. So can I file tax return as a 'Single' status?

    When I am filing as married , it is asking the SSN . But my wife was never in USA.

    Please suggest me for both the cases.

    If you are married, you cannot file single. You would need to file either MFJ or MFS.

    Thanks for the response. I am interested to know that can I file my tax return as married without claiming any dependent exemptions? Then also do I need to file W7? as it would be difficult to arrange the documents for W7 at this time.

    Is there any simple and straight way to file my Tax return at this time?

    Yes, you WILL need Form W-7 to request an ITIN for your wife, whom you can claim as a dependent or with whom you can file jointly.

    Of course, you can file Married Filing Separatelyand just list your wife's name and write "non-resident alien; no ITIN" in the SSN area. The IRS will process the return, but it will have to be mailed.
