    1040 or 1040-NR
    Hi,

    I am from Nepal, married with two kids of 10 and 8 years old. I came to USA in August 2003 on F1. My wife and kids joined me in August 2004 on F2 and all of us are here in USA after that. Now, they are under H4 and also got their ITINs from IRS in 2005. From August 2005 I was on OPT and from October 1, 2006 I am working under H1B.

    I was using 1040NR up to 2005 so far. Can I use form 1040 and jointly apply for tax return and take child tax credit for 2006? I really appreciate your help in this matter.

    If you file jointly with your wife, you CAN file Form 1040 and claim the Child Tax Credit!

    F1-OPT-H1B , Still in Confusion on 1040 or 1040NR

    Hi ATE,

    Thank you so much for your valuable time and suggestions.

    Regarding tax file for 2006, I called to IRS and they told me that I have to file 1040NR, and I can't use form 1040 for 2006 but I can use 1040 from 2007 and onwards. Since my
    H1B has started only from October 1, 2006, so its less than 183 days.

    All of my family (wife and two kids) are resident of Nepal. Still I am in confusion that can I file 1040 jointly with my wife ? (I want to use form 1040 though instead of 1040NR). I am waiting for your suggestions again.
