    On OPT. Do I need to file Form 8843?
    Dear AtlantaTaxPrep,
    I have been in the US since August 2009 and only worked on OPT in Summer 2012. I did not file any 8843 forms while I was not working here. I am now filing my federal tax returns for 2012 and I was wondering if I should fill out Form 8843 for 2012 (to take into account previous missed ones) or am I only supposed to file Form 1040NR or 1040NR-EZ and completely forget about 8843.

    Submit the 2012 Forms 1040NR-EZ and 8843 as required by the IRS.

    Once that is done, go to Internal Revenue Service and download the Form 8843 for 2009, 2010 and 2011, complete the forms, sign them and mail them to the same address you mailed the 2012 tax return.

    Better LATE than NEVER!

    Hi,
    For 2012 I will only file form 1040NR-EZ as determined by my international student tax prep software.

    I just wanted to know if there will be any penalty or problems in my H1b visa application if I file 8843 so late for 2009,2010,2011?

    Also, Please confirm if I got this right. I should send in my 2012 (Form 1040NR-EZ) in one package and send in 2009,2010,2011 Form 8843 in one package!

    I have been doing this for about 15 years, and I have NEVER heard of any case where someone was fined or otherwise punished for filing Form 8843 late, or not filing it at all.
