    Can I sue?
    Hello, Last Monday I was in a meeting with my co-worker and my supervisor in the supervisors office. While in this meeting, my supervisor called one of the partners and put her on speakerphone without letting her know. The partner also did not know we were in the office. During the phone conversation the partner was speaking about me and stated "She needs to learn how to cover her a$$.. her fat a$$ ." I have reported the incident to the correct people here at the company. My question is.. can I sue the partner or the company or both for what the partner stated?

    Rule of thumb, anyone can sue anyone for anything. However, you won't always win. What are your damages that you think you should recover? The comment was impolite and very inappropriate but you have not suffered danages. I suspect your supervisor will be looking for work very soon.

    Agreeing that yes you can sue, but you don't have a good chance of winning unless you can prove they have passed you over for promotions etc because they don't like you. You need to show his attitudes toward you have caused some kind of financial damage to get any sort of settlement.

    Being that I am overweight, would I be able to sue under the discrimination law?

    I don't believe over weight is a "protecetd class" by the government but again you have not suffered a damage. You must show that you have been demoted, transferred or improperly paid because they think you are too large. Name calling is unprofessional but it isn't necessarily grounds for a suit.
