    Does a U.S. Company have to issue a 1099 to a Resident of India for work performed through the internet?

    No, that is NOT required IF the Indian resident performed the work in India. Under the U.S.-India tax treaty, the income for such work is taxable only in India.

    Complete form W-8BEN and submit to the US company.
