I owe $1685.35 but they would be charging me with fraud over $5000.00 what can I do?

Ultimate scare tactics. They can't do anything unless they have a judgment against you, BUT statute of limitations for unsecured debit is six years so you aren't even there yet. You will have to pay but they can't charge you for anything over and above what you already owe. And by the way, it isn't fraud; and forget about the police as well, that won't happen.
