I live in chatsworth ga, I have lived there since march and I preregistered my son in may. I have not received any child support since 2-1-12. The last time my sons father seen him was the day before reggistrantion. He called our son and I did let him talk to his on our sons birhtday witch was on 4-27-12. Our child was born 4-27-07. He did not sign the birth certificate. However I did file for child support when our son was 11months, there was a dna that says he is 99.99% his child. I want to file abandonment on his father, since he has had no contact of any kind. What happenes to the father if he is found guilty and what does this meen for visitation etc. We were unwed at time of birth and never married. I also can't talk to him because of major interference with any kind of communication with him, so when visitaion is arranged its always her. Because it was our sons birthday it was him on the phone on 4-27. Will it even matter that she interferes and do I need to tell the judge at the hearing? What is the conseqences of filing this action and after how many times of fileing can I try to stop all visitaion under ga law with out stoping support from him?

I also forgot to let you know that he does and has lived in ga the whole time and I lived there at time of birth and after birth. I only live the next county over.

What is your purpose in filing for abandonment? It sounds like he's already abandoned you.

Go back to Court and get the support order enforced.

You sound like you want revenge and the Court is not going to like that aspect of things.

First, who is this she you refer to?

Second, support and visitation are separate issues.

In GA abandonment is a criminal offense for not supporting your child. So he could be jailed if he doesn't pay support.

In GA abandonment is non payment of child support, ( not the actual not seeing the child)
Things like phone calls in GA is considered contact.

Child support is not connected to visitation in any way in Georgia,

In GA his rights can not be taken away merely because he does not pay child support.

Also even not visiting can not be used against him to take his rights away in GA.

So he has legal rights to ask for visitation even if he is not paying support.

He can and will get court ordered visitation if he takes you to court for visitation

Not who "she" is, and what "she" has to do with it, so don't talk to her, if he wants to talk to the kids can he find a way without "her"

So you take him back to court for non payment, you talk to the DA about abandoment.
