Is my employer "supposed to" withhold federal taxes
My Employer misclassified me as an Independent Contractor and has been told by the DOL WHD investigator of this back Jan 3 2012. As of yet my Employer is still not withholding any taxes from me nor are they paying me overtime. They have done nothing to change my status thinking I am unaware of the investigation. What are my options? Do I owe back income tax or do they and can I sue and how much can I sue for? California Employer

You knowing you have taxes to pay, should have course be saving the taxes to pay back.

So when have you last went in and talked to the HR department and asked them to make the correction ?
