    An employer is not required to pay an employee at all after he's terminated.

    The employer is required to pay wages according to the regular scheduled pay period. If there were unpaid wages due at the time of termination due to a delay in pay cycle, then wages should be paid by the next pay cycle. Up to the date of termination

    Normally all businesses pay an employee on the next scheduled pay day.This is due to issues of figuring taxes, any other pay due or any money needed to be withheld.

    tlawler, we need more info such as does a pay period of April 1-15th get paid on April 30th.

    New Mexico labor law states an discharged employee must be paid within 5 calendar days from the day of discharge. Discharge being the key word. Separation for any other reason = getting paid on the next regular payday.

    The real list situation is few do, most still pay within the next pay period. The way it works, the next pay period is normally within one to two weeks, so by the time the person even complains the check is made.
