Get an attorney and have your husband file for adoption. The attorney will tell you what requirements you have to meet and how to terminate the father's rights. In doesn't matter that he is not listed on the birth certificate. In fact, you may have broken the law by not listing him. In most US states, if a baby is born within a year of being married the husband is the presumed father.

In any case, the court will require that the father be, at least, notified about the adoption. If he refuses to approve, his being in jail and the reasons for it, may be enough to allow the court to override his objections and approve the adoption.

Agreed, your ex's criminal record will most likely allow for his rights to be taken away, but you will have to prove all of the abuse and danger to the baby.

You will need an attorney since it gets complicated.
