30 days notice, new lease requirement
I had a one year lease on an apt, and I'm now month to month.I gave my landlord 30 days written notice that I was vacating my Los Angeles apt. 1 week before the end of the 30 days, I was unable to move, contacted the landlord and he verbally agreed to let me stay if I gave him written notice. Upon receiving the notice, he is now demanding that I sign a new lease agreement for 4 months. I don't want to sign another lease. In California, does he have to give me 30 days notice if I don't sign? He hasn't rented the unit, I'm current on the rent, he verbally agreed to let me stay. Can he evict me in the 3 days left in the month w little cause?

Only a court can issue an eviction order. And I doubt if a court would issue one under the circumstances.

No, he cannot evict you with 3 days notice. He has to give you 30 days notice that your tenancy is terminated.

Thanks for the quick answers, response was very helpful. I understand the landlord wants a potentially longer term tenant, and its his right to ask for another lease, but you'd think he would be happy to keep the place rented and not act so unreasonable, to the point of petty extortion. He wants an answer today, I'm hoping he won't arbitrarilly
Decide to rent the place and lie about our verbal agreement for me to stay, can't afford the lawyer

30 day notice requirement for tenant to move out - no lease involved [ 2 Answers ]

I rent a room out and do not require a lease. My feeling is if anyone is unhappy they can find another place. I only ask for a 30 day notice. My last tenant gave me notice the day they left, saying they were never informed about a 30 day notice. I asked for a $100 deposit, for carpet cleaning...

I live in NJ. I was unaware of the 60 days notice required before the lease end data to be given to landlord. Hi, my lease expired in the fall and my landlord and I never made any formal or verbal agreement as to a lease arrangement since (infact, I didn't hear from him until the beginning of April about it). At the middle of the month I was told I needed to move for my job, though I told him at the...
