GTG: You should file another Form 1040NR-EZ. Filing as a resident alien really does you no good because, as an Indian citzien, you can already claim the standard deduction. However, if you paid any tuition or fees, then you might want to wait and file as a Resident Alien under the First Year...
OPT to H1B tax filing, 1040NR or 1040 when married

Hello, My visa status changed from F1 (on OPT) to H1B on 1st Oct 2009, & my wife's visa F2(dependent) to H4(dependent). Since I want to file as married filing jointly, can I file 1040 instead of 1040-NR? I am an Indian citizen & I have been in the US since 2006 on F1. I will appreciate help...

Hi, I came to the US on Aug 2005 on F-1. I was on OPT till Sept 30 2008 and changed to H1B on Oct 1. I went to H&R block and he filed 1040NR. My friend (exactly the same situation) went to H&R block and he filed 1040 and 1040NR both. I am confused. Which return do I need to file?
