    Again, it depends on what court this is being tried in. In many small claims courts you aren't allowed an attorney.

    You keep asking us to answer a question we can't answer without more info from you.

    You need to answer Scott's question BUT if you were at fault and there is a Judgment, it WILL be against you and probably also your father.

    You cannot avoid it - you were the driver. He cannot avoid it. He was the owner.

    EDIT: The State appears to be Virginia. This does NOT appear to be Small Claims Court. This is something your father MUST take seriously.

    Correction - this form CAN be used in Small Claims Court.

    Sorry about that.

    But Scott is right. What does the form say? What is the dollar amount being requested?

    On the top of the paper it says Warrant in debt(Civil claim for money)
    On the claim part of the paper, it says it's for around 2700 with 6.00 interest from the date it happened. It also says negligent operation of motor vehicle. One day we got one in the mail and then a few days later when I came home there was another copy in my door,this time it was signed by the deputy clerk.On the paper it says you are not required to appear;however if you fail to appear,judgement may be entered against you

    Is there a court name and docket number? Is there contact info for the clerk?
