Child support in Indiana-18 or 21?
My husband and I live in Florida and his daughter lives in Indiana. She and her mother do not speak to us. The child has not been allowed to see her father for about 6 years. Her mother is remarried and they are on welfare, public assistance, etc.

We were counting down that we only have 2 years left to pay, but found out by accident that Indiana changed the age to 21 instead of 18.

Can anyone offer any suggestions or info? Thank you.

Is there a grandfather clause that would enable your husband to terminate his support payments when the daughter turns 18? It's my understanding that Florida is not as aggressive as most states when it comes to enforcing support orders, especially those of out-of-state origin. This might be to your advantage. I am, of course, assuming that the order originated in Indiana. Otherwise, the fact that Indiana changed the age to 21 has no bearing on your case whatsoever.

Also what state issued the child support decree, you are bound by the rules of the court that issued the child support order.

Also normally they can not go back and change current court orders, the ex can refile perhaps based on the new law, but I really doubt the changes will go into effect automatically.

Current Indiana law states that if a child is 18 years old and still in enrolled in school you will still have to pay. If the child is 18 yrs old and has not been enrolled in school in the last 3 months your child support can be terminated. So 18 years old and yes you can have your child support terminated if your case falls within the guidelines of the law. A lawyer is your best option so he or she can explain all of the laws and how they work.

I was going to say that the terms of the Indiana order, if it says it terminates at age 18, would not be changed by any new law.

But then I realized that this is an old thread.

    Thanks, Abby. :(
