    Should I file - L1 Visa
    Hi,

    Came with family on L1 Visa from India in 2007. I returned for good in Jan end 2009. Myself and spouse got wages for Jan 2009 . Should I file a tax return for 2009? If I should, what type of return should I do? The normal 1040 Form or 1040 NR form?

    If you meet substantial presence test in 2009, you will file dual status return. If you do not meet SPT file nonresident tax return. Your U.S. Tax Return: Substantial Presence Test
