    Banned from the mall
    Hello Bhayne and ScottGem

    I spoke with the security manager of the mall that I was banned to go in for a year. He said if I want to resend the tresspass I have to write a letter explain the case and request for it and tell them why I request for that.
    I told him that because sometime I come with friends ( my friends mum) and they can not walk that far, we have to walk through the mall and use it a short cut in order to go to downtown. Moreover, my suprevisor sometimes arranged a meeting in the coffee shop which is located in the mall, last year we had 5 times there for business meeting. He said when ever you have to come here for buissness meeting, just call me , and you are OK to be here, but just for buissness meeting. Again he said if I write a letter they might drop the condition of tresspass. Would you give me any key, any strong reason that I can focus on it in my letter? Do you have any experience how to convince him, he said that I can call him and then go and give the letter to him, or fax him. He looked like a nice person

    I would write the letter just like you did here. Add how much you regret your mistake and that it will never happen again. Thank him for his understanding.

    I can not find them, apparently it is removed from the list!?

    There was a glitch that removed some notes. I was sent copies of my answers; Here they are. The first is in response to the note you wrote about the letter from Sears Canada.

    This seems to be a Canadian thing that I don't understand. According to your initial report of this incident, you stole a $200 jacket which was recovered. So I don't understand how they can now turn around and sue for $500. I don't think that would fly in the US. To me this sounds like extortion. Maybe if the didn't recover the jacket or it was damaged, they could sue you for the cost of the jacket, but not for $500. But this isn't the first time someone has asked about something like this. So I think you need to talk to a Canadian atty about it and see what your rights are.

    Still doesn't make it any less exortion. They think this will reduce shoplifting. I'd like to see some figures that it does. But like I said it's a Canadian thing allowed under the case cited. So what are you options: 1) Pay the $500 2) Fight it in court, but it will probably cost you more than $500 to do so and you will probably lose 3) start a class action suit to overturn Hudson's Bay v. White. You might find a publicity hungry lawyer willing to take this on. 4) Go to the press and see if you can get them on your side to intimidate Sears Unfortunately your best option is 1). Since you were actually guilty (this was walking out with a jacket, not eating a candy bar) options 3 and 4 might be hard to do.

    I want to tell you my story.
    I turned 18 in November and went to the casino and lost 100 dollars so to ease the pain I drank, it was a cold afternoon and I was with a friend who was 16. We went to sears and I put on a big jacket and walked out, as soon as I walked out they took me down. They took me to the mall office and checked my id... I convinced the guy that I am drunk and don't know what's going on so he said he wnt give me a criminal record and he banned me for one year.
    Now in July I applied for a security check and I just got the letter back yesterday. I don't have a criminal record but it says I do have information on local record of the city, under that it says case file number. I asked the police office lady, she said I should request the files and they ll send me a copy. But I personally think it should not give me trouble because I don't have criminal record. If you guys have any experience please share it and let me know. Thanks
