I'm currently in a nasty break up, and have a child with the man. Him I never got married, and he is willing to sign over full rights to the child, How do I do so!! I live in Utah and they believe the family should stay together!! But this is a man that beat me when I was pregnant with the child (I have to DV's against him), and now is verbally abusive!! What do I got to do to get full rights to my child so I can move out of state and further my career and put my kid in a better environment

He can't just sign over his rights. If you're marrying someone else who wants to adopt your child, he can terminate his rights to make way for the adoption or in some cases the court may decide that a parent is too unfit and terminate that parents rights. You can file for full custody and make it clear that you wish to move out of the state. Your child's father does have the right to ask for for shared or joint custody and a visitation schedule but seeing as he's willing to sign his rights over I can't imagine he would ask for anything.

Let me just point out that you should ALSO file for child support.

As a taxpayer, your ex should be paying for his kid, not me.

As noted, its unlikely a court will grant a TPR under the circumstances. However, you may not need one. Since there are documented charges of domestic violence, you may be able to get the court to deny any visitation or he may waive visitation. As long as there is no visitation schedule, then there is nothing to bar your moving.

And I agree that you should be petitioning for child support.
