    Bio father never seen by child
    Okay so this is the deal. I dated my sons father for about a year. I got pregnant and haven't seen him since I was four weeks pregnant. He hasn't contacted to me try to see my son or even cared to see him. He told my father that he didn't want anything to do with my son ever. My son is now 18 months old. My soon to be husband loves him takes care of him and was there since he was born. No ones name is on the birth cirt. I put father unknown under the father info. He is a bad guy and I don't want him around my child. Since he has never seen my son and never wanted to is it child abandonment? And how can I make it to wear he can NEVER see my son with out getting into trouble.

    No its not child abandonment. Sorry. I know how you feel, my daughters father doesn't care about her either nor has he seen her since he left when she was a few months old.

    What you need to do, is get your sons biological father to sign his rights away so that your husband can adopt him (you will need to get married first, other wise, for your soon to be husband to adopt him, you will have to sign your rights over as well, which I doubt you want/will do)

    So once your married get the biological fathers consent. If you don't know where he is, locate a lawyer to decide what to do. Sometimes in some states a 'good faith search' is enough to get his rights terminated. As in, putting an ad in the paper to locate him, sending him a letter to his last known address, emailing him at his last known email address, myspace, face book, anything to locate him. If you show that you accually TRIED to find him, and couldn't, the judge MIGHT terminate his rights and give the permission for your hsuband to adopt him.

    Please pay more attention to the sticky notes that may be on the top of each forum. There is one for this forum that deals with this issue. Had you read it you would have known that abandonment does NOT apply here.

    Your best bet is to have your soon to be husband adopt the child after you are married. You WILL need to get the bio father to relinquish his rights, but based on what you have said, that shouldn't be a problem.
