    Property ownership
    I bought a house and lot from my mom and dad in 1999. They also owned the lot next door. This lot is the yard for my house. They both died several years ago and now my oldest brother is trying to sell the lot that I have maintained for 10 years now. He has paid the taxes on this lot out of my parents checking account for the last 3 years. I wanted the lot as it is my yard and where I live, but my brother is intent on selling it to the highest bidder. Do I have any rights to keeping the lot?

    If your brother is the executor of your parents estate, then he has the right to try and get the best price for the lot. How big is this lot and does it have street access?

    The lot is 100 x 80, not that big. As I said it is empty and maintained as part of my yard. It is right off the street though there is no driveway or anything. It is separated from my brother's property by a fence, though there is no fence between my house and this lot.

    Was there a will, what did the will, if there was one, say about who gets the property. But yes if he is over the land in the estate it is his duty to get the best price if the will does not tell him otherwise.

    So buy it, I would assume you get a share of the money from the estate?? If so that would work for you

    There was no will and I have 10 brothers and sisters. When I picked up the property value at the appraisal office, my parents names were still on the title. My oldest brother has just taken it on himself to take care of the situation.

    It has been several years, no someone does not just take it on, they take the property and all items and go though probate court. They can not sell it without going though the court.

    Even if there was no will, someone had to be appointed executor to sign checks. Sounds lke your brother was appointed so. So its up to him, a 100x80 lot is big enough for a house. So he will probably get more money from someone who wants to develop it.
