Did you suffer any damages from having seen something in a sealed bottled?

You write a letter to Pepsi and send it certified mail, explaining your damages.

    The Pepsi Bottling Group, Inc.
    1 Pepsi Way
    Somers , NY 10589-2201
    (914) 767-6000

Just as a side issue, how could this take your life?

My question is: how did you find it if the bottle is sealed? How did you identify it as a "tobacco packet"?

Since most soda bottles are transparent, I could see where someone might spot a foreign object in the bottle. I can also see where it might be identified.

But if you are expecting a big payday from this, forget it. You contact Pepsi as Judy advised. They will probably ask that you return it to your local bottler and you will will probably get coupons for free product.

But since you did not suffer any material damage, that's all you will get.

One other point here. Most soda is actually bottled by local bottlers under franchise sold by Pepsi. So the local bottler would be at fault not Pepsi itself.

I believe Pepsi corporate carries the coverage.

Investigations I have conducted (that spring to mind at the moment) concerning foreign objects in food/beverage - dead baby mice in cereal; dead garden snakes in canned vegetables; a condom in a can of soda; dead mice in canned vegetables; dead slugs in pre-packaged salad; a rat's head (not to be confused with a snake head) in canned vegetables; various stones and pieces of stone in various items; pieces of broken machinery in a can of soup.

The condom actually happened to my sister and I was sitting next to her when she poured the soda into a glass and the condom got stuck so she said, "What's this?" and pulled it out. My entire family NEVER drinks out of a bottle or can, based on my sister's reaction.

So - it's a common occurrence. Unfortunately. The dead baby mice in cereal happened to a pregnant woman who got so sick from the thought of it that she had to be hospitalized. She got compensated. Everybody else got free coupons so they could take part in the "what's in my food" lottery a second time.
