    What happens?
    My husband filed for divorce July2007. Since then we have been off and on several times. It has been over a year now. If we do decide to go through with the divorce, we one of us have to "re-file"? Is there an expiration period when you file?

    Did you do this yourselves or did you have an attorney do the filing for you? In any event, the Clerk of Court will send out a notice to you about a hearing that will be held to "close" your divorce case if no pleadings or activity has taken place within a certain amount of time. If you did not receive such a Notice of Hearing or any other indication from the Court that your case has been closed, please call your Clerk's Office and ask if the case is still open. It probably still is. Be sure to file some sort of paperwork to keep the case open otherwise you will have to pay the filing fees all over again and have the other party served.
