    1040 EZ or 1040 EZ NR?? How to rectify now?
    Hello friends,

    I have been an international student in the US since 2000 (I came to USA on 20 Aug, 2000). In 2001, I filed 1040 EZ NR. In the subsequent years (2002, 2003, 2004, 2005), I filed 1040 EZ even though I have been a student (Indian citizen). I did that because some of my friends with same circumstances as mine filed 1040 EZ. I have been getting refunds every time. But now I realized that I was wrong. I should have filed 1040 EZ NR. Now, how do I correct it.

    This year, can I file 1040 EZ as I have been in the US for more that 5 years now? I am a married guy. I usually file tax as married filed jointly without dependents. My wife does not work.

    I shall be extremely grateful if somebody in the forum could answer my questions. Thank you in advance!!

    You have a choise either filling 1040NR or 1040NR EZ. The later one is just simpler and shorter and makes life easier (sometimes). So you don't need to fix anything.

    This year you are a resident for tax purposes and need to file 1040 because it's your 6th year here.

    Thank you very much Vaya, for the information. I really appreciate your help.

    Now should I collect the 1040 EZ NR forms starting from 2002 to 2005 and fill them up following the instructions for those particular years and send them to IRS? Is there any additional form to attach, like 1040X?

    I got refunds every year so how can I adjust them now because I think now the tax refund/payment would be (slightly?) different, right?
