    Violation prob
    What happens when u are put on prob for a felony (battery) for 3 yrs & charges dropped, but then u violate the prob on domestic /battery. My son has been in jail for 2 months now and has a trial w mandatory witness's... what will happen to him? Will he get re instated and tacked on another yr for prob? Or will he get jail time or prison in Florida?? He only had a pub defender!

    Ok, he has two problems, first he will have to go back to court from the first crime, they will have a hearing to see if his probation should be revolked. And the charges on the first would have been dropped if he had done his probation without any violation, so now the first will not be droped at all, and he may even have to serve some of that time in prison now. Then he will have the trial on the second charge, and when it comes to sentensing, they will look that he did not change form the first crime so it is doubtful they will give him probation for another crime.

    It is most likely he will have to serve some time.
