    violation of probation on a felony drug charge.what will happen?
    In July of last year my boyfriend of 3.5 years got caught with cocaine and spent 56 days in jail. He was sentenced to 5 years probation and fines. This past Thursday he and I got into an argument, alcohol was a factor for him, and the police came and arrested him for a domestic violence charge as well as violating his probation. I told the cops he did not hit me, but since I had a bruise on my face they didn't believe me. The bruise was caused from a box falling on me in my office... just to get it straight.

    My question to all of you is "what's going to happen to him?" he is currently in jail and we have a "no contact" since it was domestic and all. His current drug sentence was 4-8 years in prison and I know they can sentence him to his initial charge.

    Since I said he didn't hit me, it's up to my boyfriend to defend that, right? I haven't received anything saying I have to testify because I already gave my statement and I wasn't the one who got the domestic charges. Someone please, please fill me in. is my boyfriend going to prison? I would appreciate any input

    Hi, kflan!

    I know that you don't want to hear this, but I think that he is probably going to be doing some time. How much time? I have no idea. Do you know who called in the complaint and what the police were told? How old is your boyfriend, please?

    He violated probation and can and possibly will be ordered to complete his full sentence. Obviously that's the idea of probation - you can live up to certain terms and conditions OR you can go to jail. He didn't live up to those terms and conditions.

    As far as the box falling on your face and causing your injury - the Police have heard that one before and I hope it is true in your case and you aren't just excusing him.

    How did the Police get called for a domestic argument? Who called them?

    My guess - yes, he's going to prison.

    He violated his probation by drinking and getting arrested. He's definitely going to prison. You'll find out how much time he's getting at his probation violation hearing. The judge will decide his fate.

    I'm not as certain as my friends are that he'll see slam time. Yes, it's true, he's only just starting his probation...

    He's certainly a candidate for time, but if he has a REAL GOOD attorney, I think he has a shot at being reinstated. Hopefully he has a good job and all the other stuff they love, like a loving family... Course, if they convict him of domestic violance, that's out the window.

    Yes, was AA one of the original requirements, what was some of the other rules, it is possible that they make him on a much closer probation watch, esp on the drinking, maybe random searches of his home and so on. You wlll need to talk to the DA and make sure they understand he did not hit you, but to be honest the police and court may not believe you, so many women lie, the next day the women normally, yes normally come in and lie that they were not hurt and so on. So often the courts will still take them to court and often still convict on just what the police officer reports he saw.

    There ARE no laws that govern employment of felons - unless, you want to get them put in a protected class of workers, like ethnic minorities, women and old people.

    That's NEVER going to happen.
