    Default Judgement/Credit Card
    I had a Default Judgement placed against me, what can I do? And what does it mean? I had a credit card that was charged off in May 2001, I received a letter from one of these companies, that bought my account, in January. After doing some research, I found out that the Statute of Limitations, in Ohio, was 4 years for Credit Cards. Now I just received a notice that a Judgement has been filed. I don't know what I need to do, and does this mean that this is going to restart the 7 years on my Credit report?

    Were you served papers on this, a notice of a hearing? When was the Judgment filed? I'd be less worried about the credit report and more worried that the Judgment allows the creditor to begin any legal method to collect on the debt - garnisheeing wages, grabbing bank accounts and so forth.

    Is it just me, or did Alexis completely steal the post from Lorigoblue?

    Anyway, this is for Lorigoblue.

    I don't see a reply to the questions JudyKayTee asked and they were very important questions.

    Did you receive notice of this suit? If you didn't, you need to go to the courthouse and ask for the proof of service of the original notice of the suit. If there is no proof, then you can file a motion to dismiss the judgment.

    If you were served, and they can prove it was done legally, they have several options to attempt to collect the judgment. They can freeze or levy your bank accounts, they can file to garnish your wages, they even have an option to levy personal property to be sold at auction though that is not very common these days.

    The real key here is were you legally served the notice of the law suit.
