    Ban garnishment in Texas
    My husband evidently is facing a default judgement on a prior credit card (prior to our marriage) and my question is--Can they garnish our joint bank account--a bank account I had prior to our marriage & then added him on?

    Unless he has his own separate bank account, I believe they can garnish your joint account. You could always speak to your bank or to the court about this, I'm sure one of them would answer the question.

    What is held in joint names is by law 100% yours - and 100% his. You both own the entire account. Yes, if his name is on the account (and it is) they can move against it.

    His separate account would not enter into this - they can seize from as many accounts as they can find.
