How To Handle Being Sued By Citibank
Wondering if anyone can give me an example of a related experience. My daughter who is in her 20s just came out of a divorce with her vehicle and a big legal bill which she is paying. She has a restraining order on her ex husband because her threatened to squeeze the life out of her amonst other things. She sold all of her jewelry to pay for things like tires and food and necessary bills. She recently found a great job and has been renting a room. Last week she was served papers from Citibank. It seems a credit card was not put into the legal proceedings of the divorce and they want their money . She is making a little over min wage. She called and Citibank refuses to wrk with her. They want an amount that is way over what she can afford. They even asked her to ask her ex (whom she has the restraining order on ) for the funds. She is devastated. She wonders if they will attach her wages, can her employer give her the boot. Also she is pursuing BK. I wonder if they can take away her vehicle? It is quite emotional but I have convinced her to face this head on. I am wondering out loud why they would rather push her into BK than work with her? I get that the credit co wants their money but I am wondering how much debt the ex hubby incurred. Anyway she called and they said she did not have to show up in court the first time but she would the second time. As a layman, I do not know what to tell her. What can she do to state her case in court? Will she have any say at all? Does anyone know someone she can call to get a settlement or is she out of luck at this point? I worry about her only because this year has been a very hard one. And now this. Any help is appreciated. Thanks

Were the Attorneys aware of the debt and forgot about it in the settlement agreement? Did your ex son-in-law hide the debt?

    Is it even her debt?

She should most definitely not skip any Court appearance - she will suddenly find out that there is a Judgment against her and then she's out of luck.

If she is going to pursue bankruptcy - and this might force that issue - it will be discharged.
