    h1b and 1040nr
    Hi
I would like to know little about the form 1040s. I came from India on h1b. Last year I filled 1040nr. Now I am married and wife hasn't her ssn nor itin. She is not eligible for ssn and has no income. Do I need to file a joint return ot what. And how can I claim her exemption and which form should be appropriate, 1040nr itself or 1040nr-ez
    Thanks
    Sachin

    Sacin:

Yes, you CAN file jointly with your wife and you BOTH choose to be treated as resident aliens aofr ALL of 2007.

You would probably file Form 1040EZ as the simplest form to file.

You would need to submit Form W-7 with the return to apply for an ITIN to seve in place of the SSN on the Form 1040EZ. You would also submit a notarized photocopy of her passport with the W-7.
