    Bank Account Levy
My husband has a judgement against him with a credit card company and they have put a levy on our checking account and took all of the funds we had available! Can they do this or is this suppose to work like a garnishment where they can only take up to a certain amount?

    Thanks !

The levy is only for the total amount of money in your account on the day it was levied. It tends to be Mondays when this is done, the bank usually receives a court order on Thursdays and it takes usually 2-3 business days to verify the judgment is legit. It usually takes 21 days (differs in each state) when the money is released and paid to the collector. They can only get a bank order for what is owed and nothing else.
