    Who do you call when your employer won't give you your paycheck after termination?
    Hello. My boyfriend just put in his two week notice last Friday after finding a better paying job. After six days, there was an investigation done by local detective. Nothing has been concluded so far but it did result in firing 5 people. There is no proof that any of these people did anything wrong. It's the management saying that there was theft going on but nobody had any hard evidence... which I strange since the shop is covered in cameras and microphones. It has been longer than 24 hours since my boyfriend was fired and his employer refuses to give him his check... the employer says that its not the law (in the state of MN the employer has 24 hours) and then he changed his answer to its 24 hours after requesting your final paycheck. He told my boyfriend that he would MAIL the check 48 hours from now, which they did not agree to. Also, my boyfriend had earned a weeks worth of vacation hours which they will not pay him. My boyfriend plans on fighting these allegations and wants to go after his money and former employer. What is he entitled to (paycheck and/or vacation pay) and who do we contact? He has already called the unemployment office in hopes of starting an investigation to this situation. I have recommened that he request the reason for termination in writing and also a copy of his personal file, which are his rights. The former employer has stated that he has no obligation and to get off the property. I know that he has rights and that his employer is being a jerk. Laws are laws... we live in Minnesota... how does my boyfriend enforce that his employer follow these laws?? Who do we call to file a complaint and what is the next step?

    p.s. a clearer picture of this situation is that half of the auto shop (about 5 of 11 people) were putting in their 2 week notices to work at a different auto shop w/ better pay. The first two guys put in their notices at the same time. Six days later came allegations and interrogation to the whole staff present. He was let go at the end of that business day whereas others were escorted out directly following interrogation. The following day, 2 more employees of that company walked out and quit. I think the management/owner is just being indecent because of the reaction by his staff due to his accusations... and he's down 7 people ranging from tech to mechanic which is propbably making things not so easy. No reason to break the law though.

    Hello jack:

    OR, you can just sue them in small claims court. I think it's more quick than calling your local bureaucrat. Besides, the court has teeth. Bureaucrats don't.

    What do the written HR policies of that company state in terms of final paycheck?

    Does he have his most recent payroll stub to prove that he is owed for the week's vacation time?

    Are there other circumstances in which his companhy is authorized to withhold certain monies---is payback for health insurance, union dues, etc?

    I can not speak for your states law, but anywhere I have ever worked, you receive your last paycheck on the next payday, after your employment ended, most companies today use payroll companies and have no ability to do over night checks
