What is the law in MN. We have full legal and phy custody of our grandson and are requesting his parents rights are terminated due to it being determental to him having any contact with them. There are abandonment, neglect and abuse issues involved. We are doing our best to keep him safe. Due to our own health issues we are having extreme financial problems just suporting our own children in the home. Is it possible to request a tpr but continue child support up until adoption on our behalf which would come later?

Rights and responsibilities are not linked.

However--courts are VERY reluctant to terminate rights without an adoption pending most of the time. Since there is abuse involved in your case, I don't know what would happen.

Do you have a lawyer? What does he/she say?

Yes we have a lawyer but he is not the greatest due to our financial situation and half the time can't keep our case straght. He doesn't seem real sure about much... my confidence in him has dropped to a low from when we used him years ago. Are you sure of have a link to something legal I can refer to showing that terminating rights would not terminate responsibility? We have the love, concern and willingness to do this. We have the fear of them being able to bring it up in court later as I have seen happen. We have the desire to adopt him and raise him in our family. But due to our financial situation due to health issues my husband and I both have had come up in the last 2 years we need them to continue with their financial responsabilities. A person can always make it work one way or another but realisticaly we need that.

Are you the ones trying to adopt the child?

Yes eventually that will be the case... as stated above "We have the desire to adopt him and raise him in our family" as a permanent part not just a grandson being left behind in our home to be cared for.

Then since you want to adopt the child you go ahead with it. And not take your time. Because if you go into a court and tell a judge like you told it here they may laugh at you. But if you seek an outright adoption then you will be taken seriously. Its about the child not the money.

You will have to get temp custody or guardianship to get support, do you have that yet ?
