Hi, I need some advice. Discover card is suing me because I owe them 7500.00 I am not ignoring the debt. Just couldn't afford it. I am currently on unemployment and live in pa. Can they garnish my pay being on unemployment? Also I have a van that I am paying on monthly. Can they take that if the bank owns it?? Thanks for your help!

You just can't IGNORE credit card companies. Usually if you have a problem and can't pay it pays to be honest and up front with them and then they work with you to repay the debt.

I think PA has strict laws regarding attachments and garnishments... not sure what they are though

It is not Discover card that is suing you. Even though it is their name on the suit. Discover sells off its debt to investors whom hire these scumbag Lawyers to sue you. Where you got them is first ask for Validation. They cannot come up with that and at the pretrial it will be dismissed. Then they will take you back into court and give just a piece of billing to prove you owe. This is not validation. You need them to show a signed contract. But most of the time they win this way. Fight saying they never sent you a letter for which you had 30 days to dispute. But what you now are saying is hearsay unprovable. This wins their case. My advise if a card company is suing you and this happens then show the Judge this does not prove Discover is the one really suing you, this is just a billing, hearsay. You make them prove that Discover card is the true ones suing you. You will have to counter sue suing Discover card and prove that Discover card which is listed as the one suing you. This way you catch them in fraud, this is a criminal charge you will have on them and prove your case. So it will not be you that will have to pay, it will be them. Once you file your counter claim they will be paying you to not sue. Most of the time nobody ever questions whom is really suing them when it comes to a bank but if you can show that they lied you're the big winner. The counter claim once Discover is served they will tell all. Always question whom is really suing you all the debt collector are resorting to lies. It is a big scam. One more thing help us all tell your states attorney general and every agency you can complain to. So many people are being done wrong by these crooks. Don't pay these people, fight them.
