    Military move and my apartment lease
    My husband has been told that we are going to be relocated. He has not received his orders yet but we are certain it is going to happen with in the next 30 days. We put in our 30 days notice with our move out date set to July 3rd. I got a phone call from the apt today saying that I will have to pay the entire month of July. When my husband asked about a month ago they said it would be pro-rated. But because they had a new company take over the complex they are not honoring it. Is there any law in Texas saying that I can't be charged the full month?

    The new company cannot change any of the terms in your existing lease, without you agreeing to, and signing an amended lease to incorporate the new terms.

    If the original lease, states that you must vacate prior to the 1st day of the month or would be charged for the entire month, that is the only way they can charge you for the full month.

    What does your original lease say about early termination?

    There are special rules ( I am not up on them) that effect military moves and being allowed to terminate a lease. I don't believe they have to prorate but not 100 percent sure, He may want to check with the military legal system on base, I am sure they will have info

    My original lease says that I have to give 30 days. It does not specify anything about me moving out after the first. When the lady called me today she read off my original lease and then read into it saying I was responsible for the full 30 days. She pulled it out of her butt that's why I came looking for legal help to back me up.
