Sublease unsigned
I recently took over a lease in (FL.) for a friend. I never signed the lease but I did sign a roommate exchange with the other two parties, also my parents co-signed for me. I have the original lease agreement witch the property mgr. just brought to me to sign. I've been living in this apartment since January. I would like to get out of this apartment is there any hope?

Did you sign the lease the property manager brought to you? Tell us the language of your roommate exchange/ agreement. Back to you.

I never signed any copies of the lease. The exchange states, word for word: I adam G. being a residant residing in apartment 1 agree to add spiderman1 to my current lease agreement. Spiderman1 agrees to be added as a lease holder and understand I will be held responsible for all lease terms policies agreements rules and regulations currently in affect between the apartments and Adam G. I have paid the processing fee and any requested deposit and my application for residency has been approved by management.
The second part of this states: I Adam G. being the resident at the apartment agree to release my roommate Brian B. from all lease obligations. I Adam G. agree to reliquish all my rights privileges and obligations as contained in my lease. I've negotiated the security deposit with my roommate and understand the deposit will be refunded to the lease holder at the time of lease expiration. All three parties signed including the property Mgr.

I don't believe you are held by the landlord for any rent. However, you guys created an agreement that may hold water in court. The landlord has not initialed this agreement and he does not have to follow it. As far as he is concerned Adam and Brian pay 50/50 but he doesn't care who does the paying. It would be a cleaner break if all of you start recruiting a new person to take over your share. So far it doesn't sound like Adam has done anything wrong so he should not have to shoulder the whole burden. You might know more about that than I.
