    Is she a guest or a tenant
    I have a situation in California where a person has stayed in my apartment for four months as a guest. I am giving up the apartment on the 7th and she is refusing to leave.
    She is not on the lease and she does not and has not paid rent. Its too late for a thirty day notice and she doesn't pay rent so I can't give her a three day notice. Can't I just change the locks

    Hello m:

    If you leave and your guest/tenant doesn't, your landlord will simply say that YOU haven't vacated the apartment yet. Until you (they) DO, you'll be responsible for paying rent and you'll be responsible for any damages caused.

    Although changing the locks is illegal, I'd do it on the 6th, have her stuff on the street, and have your apartment ready for a walkthrough on the 7th. All she can do is sue you and I doubt she will.
