    Real Estate Eviction
    Could you please give me the requirements to evict a tenant in a home we own in Virginia. Thank you.

    We'll find that answer somewhere in the Virginia Residential Landlord and Tenant Act, but I would strongly suggest having an attorney do it for you.

    In Ohio and eviction means 2-3 trips to the courthouse to wait in long lines to file documents, waiting for the case to be called on the court date (all evictions are filed for 9AM... it's first come first served for the plaintiffs).

    The attorney handles all of this for $150. Well worth it in my opinion.

    If the eviction is for non-payment of rent, you must give a "Pay Rent Or Quit" Notice to the tenant before beginning the eviction process. I think the notice must give them 3 days, but I'm unable to find that for sure from the Laws link.

    Most cities have an Apartment Association that supplies forms and info to landlords. I'd look them up in your area and ask them for the form that complies with VA law. It shouldn't cost you more than a couple bucks... if anything at all.

    From there you can decide on whether you want to file it yourself or not. If you want to do it yourself, the local clerk of courts can direct you to which forms to file.
