read asap TX, APT - How many days until i have to move out?
Here is the situation! I live in Dallas, TX - I was unable to pay my (September Rent) 700$ due to family issues and emergency funds being used - I told my landlord That I would pay her 1400$ on the (1st) of October. It is now October 5th and I've gotten 2 Notices about the Sep Rent - One stating I owed 900$ (700 for rent) and the other 200 because as a part of my lease that states I have to pay 10$ Late fee for up to a maximum of 20 days due to non-payment of rent. I decided to get a different apartment with someone else, who they are going to be the only name on the lease, with their parent as the cosigner and a separate lease is going to be drawn up for me and notarized by the bank by the cosigner ( who is an apartment manager herself ) stating that I owe her 1/2 the bills when I move into my new apartment for the entire term of the lease.

I know that sounds a little confusing, basically what I'm asking simplified is, I didn't pay sep. rent, and owe 200$ of late fees, And because I'm moving out around oct. 14-16 into the new place, I also didn't pay Oct. rent because I don't care if I have an eviction on my record or not, I'd rather save the money because it's not going to affect me anyway (I know it'll be on there for 7 yrs, or however long) I'm just trying to save the extra cash.

She told me she is filing for evicion on the 6th of October (Tomorrow). By TX state law, after eviction is filed, do I have 30 days to move out, or could I come home on the 7th and my locks changed or a constable throwing my out? Or will I have time to wait until the 14th-16th when I move out?

Any help that is offered I am grateful for in advance - This is urgent because of the timing situation, because if not I just want to suck it up and pay my landlord the 1500$ or w/e I owe so I have time to move out and not get put out, But I'd like to save that 1500... If you have any information and feel comfortable doing so, No matter what time of day or night I'd appreciate if someone would call me as I might not be able to check this - # (817)-770-7230; or just post on here and I'll try to check it.

Thanks very much all you helpful folks =]

    Hello Im:

Depending on how efficient the courts are and how efficient she is, you probably have at least 3 weeks before a sheriff comes to put you out.
