    Question on Tenant Rights / State of Virginia
    I have a question regarding tenant's rights and the law in the state of Virginia. I am currently involved in a dispute with another tenant in the complex where I live in Henrico County. I have contacted the landlord on 11 occasions regarding complaints of excessive noise coming from the tenants who live next door to me. I am told that they have filed a counter complaint with the landlord. When I contacted the landlord earlier today, I was told that both files had been tagged, and that a 30-day notice would be issued to both myself and the tenant next door, if any additional complaints were received. As background information, I have been a tenant in the complex for 5 years, with no prior complaints filed against me, my rent has never been late, and I am always offered additional options to renew each year, due to my history as a tenant. Based on the information that I provided, I would like to know what my options are if I received a 30-day eviction notice based on the information provided above. Any clarification that you can provide would be greatly appreciated.

    Hello mt:

    If you're a month to month tenant, and I'll bet you are, there's NOTHING you can do if you're given 30 days notice - and they don't need a reason either.

    I have NEVER been a month-to-month tenant. I've lived here for 5 years, and I always renew for 1 year, and they always knock off $$$ because my rent has always been paid on time (never late in 5 years - not even once). Also, I forgot to mention that the tenant that I complained about just moved in a few months ago. So does this give me some options?

    They will have to follow the terms of your lease, if the lease allows them to breach the lease if a tenant has a number of complaints then they may do this, since it is in your lease.

    You can object it and refuse to honor their notice and force them to take you to court to evict, you can present your case to the judge who would be the one to issue a formal eviction.

    But the person who complains all the time about another tenant, I think excon and I both could have told you to see it coming, normally it is the person who keeps complaining that gets kicked out first

    So what you're essentially saying is that the fact that I've been a "good" tenant for 5 years with no complaints and no late rent, counts for nothing? Even though they are "new" tenants, I would be the one who gets kicked out first? That makes no sense to me. Well, I'm not renewing my lease, so I guess it doesn't matter anyway.
