    Pay rent or quit notice
    Renting an apartment in Kansas... just received a "quit or pay" notice "within 3 days". Can't pay. How long do I have before being evicted? What are the next steps? Thanks!

    Not 30-days for a "Pay Rent or Quit", which is the formal name of the notice required before filing for an eviction.

    The landlord has the right to file the eviction on the 4th day. The court date will be set based on when he files. In my County the court date is set for 2 weeks after the day it is filed.

    Hello Jarvis:

    If you do nothing, you've probably got a minimum of 30 days before an officer shows up at your door to put you out. That, however, depends on how efficient the landlord and/or your local court is. Therefore, it could be longer.

    If you put up as many legal roadblocks as you can in front of the landlord, you may have as much as 2 maybe 3 months.

    What are the steps? You're going to be invited to court. If you don't show up or don't have a valid defense, you'll lose. The landlord will then seek to have his judgment executed. Then a cop with a gun will show up at your door to put you out on the street.

    Some courts are tougher than others. Here in my county it is pretty much "landlord always wins and wins fast". I'm not saying that's good, I'm just pointing it out.

    I run into 2-3 evictions a year, and the timeline is pretty consistent.

    Day 1 - give pay rent or quit notice
    Day 4 - file the eviction
    Day 18 - Red Tag ends up on the door
    Day 23 - Meeting the Bailiff (not a cop, but he is armed) for the setout.

    Yes, BUT make sure to get a receipt for payment, with confirmation that you are current.
