    Notice to quit
    I have real estate property in Texas. Six months ago I verbally agreed to a week to week rental, but the tenant continually failed to pay in a timely manner. In March, I notified the tenant (verbally) the beginning of April the rent would be due monthly. His June payment was late again, and I just received notice that the check was returned for insufficient funds. How many days notice do I need to give him to quit or pay rent?

    Hope this helps

    From start to finish approximately three weeks.

    * 3 days from notice to vacate to filing of suit
    * 8-10 days to serve the citation- The law requires the defendant have six days notice before the hearing.
    * 5 days to appeal the suit following the hearing required by law.
    * 2 days- The Constable is required by law to post a 24 hour vacate notice on the Writ of Possession

    A verbal contract is NEVER a real contract in the courts eyes. Once you have rental properties... consider yourself a business owner. Write it Down! All contracts must be written down and all notices delivered by certified mail.
