    Non contency offer --- urgent!
    Hi, All:
    Me and my boyfriend signed a non-contingency offer on a house last month, after a week, we found there is some issues in the house and want to back out, we send the seller an fax with "Cancellation the contract and request return all full deposit" form, But seller want to claim some damage. They claim half of the deposit as damage (in this case is 14000$). We think it is not reasonable. After one week, As we still negotiate of the amount of damage, Seller agent inform us he already sold the house and we have to wait for closing to get the other half deposit back. We don't think it is fair, In this case, Can seller agent legally sell the house when we still in the contract? Can we back into our contract now because the "Cancellation the contract and request return all full deposit" which was rejected by the seller? My agent confirm us that we can still close the deal at the same day we promised. What we should do to protect ourself?
