A little confused about South Carolina eviction laws
Can a landlord evict you with a 3 day hand written notice in the state of South Carolina ? I have not been able to find specific laws concerning South Carolina eviction laws. This is a month to month rental, no kind of written agreement at all.

SC's laws are somewhat confusing but it looks like, if the reason for the eviction is non-payment of rent then the landlord must give 5 days written notice before eviction proceedings can begin.

If the reason is for other than non-payment of rent then the landlord must give 14 days written notice.

The applicable law is Section 27-40-710 and can be found at S.C. Code of Laws Title 27 Chapter 40 South Carolina Residential Landlord And Tenant Act - www.scstatehouse.net-LPITS.

And as LISA said, this is just to start the actual eviction, which is to file in court for a hearing,

    Hello wife:

If you didn't pay rent, the landlord is going to win. If he's efficient, and the courts are too, you might have 2 weeks before the sheriff shows up to put you out.

My mother was renting a house. She did a lease agreement with the young lady for a year. The lease was signed on May 30, 2011 according to the landlord. My mother lease was up in May 2012 but she never heard anything from the landlord about renew her lease for another year. My mother paid her rent for the month of June 2012. She was late and made arrangements with the Landlord to pay her rent for July 2012 on July 16, 2012. My mother called her to explained to her that she only had a portion of her rent and if she could pay her later. She has made arrangement with her in the past considering her rent. She stated that my mother had to pay her a late fee for her July 2012 rent. I stated to my mother that her lease agreement was up since July 2012 and she never renew her lease. She stated to my mother that she wanted her out of her house on August 16, 2012. I stated to my mother that she will have to file an eviction notice to have my mother removed from the house. How does the eviction process work for non-payment in South Carolina? When the eviction process actually begins? Is it after the eviction notice is served that you have 10 days or 30 days to out of the house? My mother has always paid her rent on a timely manner.
