Lender delays cause hardship - liable?
I have been in Escrow for 10 weeks, and the lender is still saying "just 24 hours"... My agent is furious, the seller is exhausted and I'm at my wits end. I submitted all my information to the lender about 12 weeks ago, was pre-approved (yada yada). I was told everything looks GREAT and gave my landlord 2 mo notice (reasonable amount of time I thought). Our first extension was for Oct 20th due to a 203K loan that was being included in the FHA loan. Then come to find out the underwriter had "dropped the ball" they said, and we requested another extension for 10/30. On 10/26 ( 4days before closing, they finally did a VOE - it was great), and looked like the 30th would be not probably because once again the lender said his underwriter had "dropped the ball". 10/27 we had to move from our rental to a hotel, stuff in storage, pets in boarding, etc thinking maybe another week. On 10/28 I was told that the 203K would not be funded for a few reasons 1. a C7 BK 4 years ago in December (FHA has a 4 year rule?) 2. the appraiser that they sent me to had never done a 203k and nor had the lender had much experience (exact words). SOOO here we are Nov 10th and every single day I hear waiting for this signature, waiting to hear from corporate, excuses excuses - problem is I have 10K deposit with the Seller and sign contigencies since the lender said it would only be another week... this was 2 weeks ago. I am furious, homeless and hemmoraging money in this hotel with my family of 4 - What can I do?
