    Lease Agreement
    I live in Pinole CA. On October 16, 2006 I renewed my rental agreement for one year. The old one was due to expire on Nov. 30, 2006. The new agreement was effective on Dec. 1st, 2006.

    On Nov 29th my landlord put a revised rental agreement on door stating that she had did an audit and a mistake had been made on my rental agreement, and it was therefore being revised to a 6 month lease instead of a one year lease, I received this notice one day before the new rental agreement was to take effect.

    I called her the next day, and she said, she shouldn't had renewed it for one year, and that her boss was very upset with her, and that I should sign the 6 month lease, and after the 6 month lease it would go from month to month, and then she informed me that after that she would give me a 30 day notice to vacate. On Dec 1st, I paid my rent, she accepted it.

    I've not signed the revised rental agreement, My question, is My first rental agreement that I signed is that binding, what will happen if I don't sign the revised rental agreement. I've lived at this apartment complex for 15 years. Is there anyone out there that can help me?

    Hello Modica:

    She's going to give you a 30 day notice NOW, if you don't sign the 6 mo lease?? Or, she's going to give it to you after 6 months?? I don't understand. It sounds like she's threatening you NOW to cover for her mistake.

    Well, it's time to turn the tables. You've two things to consider: (1) the one year signed lease IS binding on them, and you can force the issue. (2) However, something has occurred within the management of the building. Even though you've been there 15 years, it sounds like your continued stay may be in jeopardy. You might wish to vacate now.

    However, the owner of the building wants you there, even though his manager isn't treating you as though that were the case. Write a letter to the manager with a copy sent to the owner. Send it certified, return receipt requested. Tell them that you are holding them to the signed lease you have in your possession. If they wish to BUY you out of it, you'll listen to their offer.

    PS> Of course, it could be a new owner who wants you out for some reason or other, and the manager is doing his work. In either case, you should find out.

    Your 12 month lease stands. Her BAD does not mean you have to do her a favor... she made the mistake and her employer/property owner has to honor your lease.
