Are home inspectors liable for their mistakes in the state of pa.
The basemnt drains were broken and not noted ont the inspection while a number of other items were targeted for repairs that wer never done. WE HAD SEWAGE BACKCU PR THRIUGH THE SHOWER AND WATER FLOOD THE BASEMENT SOAKIN HALF THE CARPET AND RUINING BASE BBOARD AND WARPING PANELING AND DOORS. We have had a licensed plumber in and he rplaced a drain in the wall and jackhammer up a 6 ft section of then basement floor to find where a pipe was broken between the floor drain and the basement bathroom.The kitchen and upstairs bathroom drain down a diifeerent pipe and have no problem. We completely renovated the first floor of the house, floring kitchen,piant fixtures etc. Now we are getting the run around from the listing and selling realtors,home inspector and home warranty company. We closed in October and now I have a 15to 20k claim with my home owners ins. And a thousand dollar deductable. Wam also out of pocket for the plumbing repairs already completed. I am a big boy and know I am responsible for my life and the things that go wrong, however I think there are a lot of other entities that should have some skin in this game.

The answer is, if they did in fact make a mistake, they are liable. On the other hand, if they inspected everything their contract said they would inspect, and the trouble was somewhere they were not obligated by contract to inspect, they are not liable. In other words, read the contract.
You say the inspectors are giving you the runaround. What exactly is their excuse? |

Read the agreement you probably signed with the inspection company.
This is a sample PA inspection agreement: http://phic.info/contractsample.pdf Did the seller provide a disclosure form? Disclosure was not required when I purchased my home in PA. Don't know if that has changed or not. Some sellers provide it anyhow. Was there a disclosure provided? Have you talked to a lawyer?
