    Getting back our deposit on commercial property rental
    Hi,

    We used to rent a commercial propety for our business which was sold last September and the lease was moved to the new tenent. Our lanlord has yet to return our deposit. He mentioned there needs to be some AC repairs to be made which will be deducted from our deposit. Its been more than 4 months now and we have not heard back from him at all. He never returns our calls either. What is the best way to resolve this situation and get our deposit back.

    Hello Business:

    I don't know. Commercial landlord/tenant law is much different than residential. Having said that, your lease must address something of this nature. If it doesn't, then you're on your own.

    Write him a letter. Threaten to sue if he doesn't immediately comply with your demand. Send it certified, return receipt requested. If he doesn't comply, sue him in small claims court, assuming your deposit is less than your states maximum small claim.

    By the way, AC repairs ordinarily WOULDN'T be something that a tenant should pay for, unless of course, YOU broke it.

    Leasing of commercial building space is not the same as renting a home or an apartment. There are four types of commercial leases. One of the differences between the four, is the financial responsibility of the tenant. Example: who takes care of roof repair, snow removal, heat and air conditioning repair, water usage, insurance, floor and wall damage, construction specific to the particular business conducted etc. You need to review your specific lease and find out what you agreed too.
