    Evicting a family member
    My son is 24 yrs. Old and he and his girlfriend and 2 kids live with me. We cannot get along and do not see this changing so today as he told me how much of a I was I told him to get out of my home. He lives here rent free and has for the past 4 months. He has no job, they receive money from the state, I have no idea how much. He informed me that I have to evict him because he receives mail here and his children are here. I have little money for legal costs but know that if this goes on something bad will happen. It is my home and I am going to have to do something. I am disabled which I don't know if that has any relevance at all but is a fact. This is not what my intentions were but is how it is turning out and I cannot handle it. I live in the state of Missouri, can you please help point me in some direction? I would like to keep this as easy as possible on everyone, especially the kids but foresee nothing good coming from this situation:( Thank you very much.

    Contact the local small claims or magistrate court. Ask about the procedure to evict a family member who refuses to leave your home. Ask the clerk to mail you the forms you will need.

    Do you live in a small town or a large city? Your best bet is to go to the local courthouse and ask about the process for eviction. Your son is right that since he has established residence there, you would have to evict him, but eviction does not have to be expensive. Since he pays not rent and has no lease he has no grounds to remain, so a court will order the eviction, but you will have to evict all of them. You can't just kick him out and allow the girlfriend and kids to stay.
